Did Elena Kagan Violate the Law?

According to Sen. John McCain (R-AZ), she did.  As a recipient of federal funds, Harvard University was required to allow military recruitment and ROTC on campus.  She was also required to not apply any university non-discrimination policy to the  military organizations on campus.  When she kicked off the recruiters and ROTC, she knowingly and willingly violated U.S. law.

Ideological considerations aside, does someone who willfully violated federal law have a place on the highest court of the land?  Lawyers and judges are sworn to uphold the law.  Does this issue provide a smoking gun that the GOP can use to block her nomination and take Obama down a peg, or will the squishy Republicans simply roll over as usual?  Somehow, I sense the latter.
