Judge “Severs” Obama Care’s Head

It’s all tied up at two-a-piece:  two judges uphold Obama Care, two judges strike it down.  The House passed repeal a few weeks ago, while the Senate is poised to take up the debate, perhaps even today, emboldened by Judge Roger Vinson’s ruling on Monday.  If you haven’t had a chance to peruse Vinson’s ruling on Obama Care, it’s worth a look.  It’s absolutely crushing and will test whether any Supreme Court Justice one day hearing this case has any fidelity to the Constitution at all.  Plus, he uses Obama’s own words against the law — Libs hate that!

Also, I was truly shocked to hear that the “severability” clause in the original legislation was somehow taken out of the final product.  I know no one read the bill before it became law, but this is a serious snafu!  “Severability” clauses are usually included in big pieces of legislation because it makes sure that if one part of the law is struck down legally, the rest of it remains generally intact.  With the individual mandate on the chopping block, the whole monstrosity potentially falls apart.

So, in the biggest piece legislation since the Great Society, the Dems somehow forgot to leave this clause in?  Either that was sheer stupidity or shrewd political calculation:  if the law remained constitutional then it’s a moot point, however, if not then the door might be opened to tinkering and political cover as we near the 2012 Election cycle.
