Obamacare Ruling This Week

The Supreme Court is going to rule on two big issues this week:  Arizona’s illegal alien law and of course the big one — Obamacare.   Like many out there I see three possible rulings:

  1. They uphold the law.
  2. They try to split the baby and uphold some of it while striking down the rest.
  3. Realizing #2 is likely to stir up more issues than solve, they strike the whole thing down and tell Congress to try again.

I’d prefer #3, but I’m betting on #2.  If the individual mandate is upheld, then we’re not America anymore.  When a government can compel people to purchase a government-desired product as a condition of citizenship, it’s a whole new ballgame — we cease to be citizens and become subjects;  the American Revolution will have exhausted itself and we become like everywhere else in the West.

That’s not hyperbole.  Jefferson once noted that “the natural progress of things is for liberty to yield and government to gain ground.”  He’s right.  The individual mandate is the doorway to a whole new relationship between the government and the people.

That’s why I think SCOTUS has at least 5 votes to toss out the individual mandate.  However, the justices can read polls and, wanting a piece of the action, I think they will attempt to tinker with the law.  Beats option #1.  We’ll see how it all shakes out this week.
